Decision Notice - Analysis of the market for the provision of wholesale fixed access in Malta
The Malta Communications Authority (MCA) is hereby publishing its Decision concerning the definition and competitive assessment of the wholesale market for the provision of fixed access in Malta. Given the findings on competition dynamics in the market under investigation, the MCA considers that the implementation of ex ante regulatory remedies is no longer required. The MCA will therefore withdraw the regulatory remedies that currently apply on GO, by way of the SMP designation imposed on this operator as outlined in the MCA Decision concerning 'Market 4 – Wholesale Unbundled Infrastructure Access Market' published in 2013.
The withdrawal of the VULA remedy will be subject to a twenty-four (24) month sunset period. This decision follows a consultation exercise carried out with stakeholders between the 21st of February and the 11th of April 2025. The MCA took into account the submissions made to this consultation and notified the relevant draft measure to the European Commission, to the body of European Regulators for Electronic Communications (BEREC), and to the national regulatory authorities in other Member States. The European Commission registered the notified draft measure as Case MT/2025/2606.
