Circular to Operators re imposition of administrative fines
In accordance with the Malta Communications Authority Act [Cap. 418 of the Laws of Malta] [hereinafter referred to as ‘Cap. 418’], the Malta Communications Authority [hereinafter ‘the Authority’] may impose administrative fines if there is a breach of any of the laws, authorisation conditions or decisions however so described that the Authority enforces.
Decisions issued by the Authority imposing such fines may in turn be contested before the Communications Appeals Board [‘Appeals Board’].
The Authority may, notwithstanding an appeal of any such fine before the Appeals Board, proceed with the collection of any such fine in accordance with the provisions of article 33 of Cap. 418 unless the operator concerned concurrently or with the filing of its appeal, requests the Appeals Board to suspend the effect of the decision imposing the fine.
The Authority informs all operators that in those instances where no application to the Appeals Board for the suspension of a decision imposing a fine has been filed in accordance with article 33(5) of Cap. 418, then the Authority will proceed with the collection of the said fine.
